This Privacy Policy is intended for all those who visit our websites and/or use an Energy3000 App and/or use the services offered therein. This Privacy Policy applies to any form of use of our services, whether free or paid.

1.2 In particular, Energy3000 would like to inform you exactly which data Energy3000 collects and how it is used. You will also be informed that personal and non-personal information is collected and electronically stored on our websites and apps. All data will be stored and processed by us in compliance with the relevant legal provisions on data protection and data security of the European Union and the Republic of Austria. 2. Connection data

2.1 Our websites and apps may be visited at any time, subject to availability, without you having to provide any direct information about yourself. Energy3000 stores the following data without direct personal reference (connection data):

a) Browser type and version

b) operating system

c) Refferer URL (the actual website you visited)

d) Host name of the accessing computer (IP address)

e) Time and date of server request device

2.2 This data will be evaluated and used by Energy3000 for the purpose of the proper functioning of our website, the provision of its content, detection of misuse and tracking as well as for the improvement of our services (eg by means of research, data analysis, etc.) or in anonymous form by a third party.

2.3 Energy3000 also collects and stores the data mentioned in 2.1 above from registered users, whereby use according to section 2.2 also takes place exclusively in anonymous form. A conclusion on your person by the possible commissioning of third parties using this data is no longer possible.

2.4 Due to the use of Energy3000 websites and Energy3000 apps by registered or activated users, Energy3000 also collects non-personal or anonymised data. b) Plant data: plant name, plant identification, commissioning date/time, company, street, house number, zip code, city, state, country, time zone, longitude, latitude, altitude, plant performance, manufacturer, module type, plant description, plant image

c) Operator/customer data: salutation, first name, last name, company, street, house number, postal code, city, state, country, time zone, telephone number, fax number, e-mail address, customer number, VAT identification number

d) Connection data: data according to point 2.1

3.2 Energy3000 collects the personal data for the provision of the desired services, for the implementation of pre-contractual measures, for the execution of contracts and for the improvement of our services and products.

3.3 After registering, you can make your username visible to other members. In addition, you may share or publish additional information about your profile or attachment and make it visible to other members. Within your profile, you have the option of adjusting the extent to which your data is published by adjusting the settings. It is at your absolute discretion to decide which and to what extent this data will be shared or published to other users. 3.4 If we use data for a purpose that requires your consent in accordance with the statutory provisions, we will ask for your express consent. 4. Use of cookies

6. Google Analytics Remarketing

6.2 This feature allows you to associate the advertising audiences created with Google Analytics Remarketing with the cross-device capabilities of Google AdWords and Google Double Click. 6.3 Once you have given your consent, Google will associate your web and app browsing history with your Google Account for this purpose. That way, the same personalized advertising messages can appear on any device you sign in to with your Google Account.

6.4 To support this feature, Google Analytics collects Google-authenticated IDs of the users that are temporarily linked to our Google Analytics data to define and create audiences for cross-device ad promotion. 6.5 The aggregation of the collected data in your Google Account is based solely on your consent, which you may submit or revoke according to Google privacy policy. 8. Disclosure to third parties

8.1 All personal data will be treated as strictly confidential by Energy3000 and will not be disclosed to third parties without your express consent.

8.2 Without your consent, Energy3000 will only collect, process or use your personal inventory and usage data to the extent necessary for the execution of the contractual relationship and for the use and billing of electronic information and communication services.

8.3 Passing on to third parties by Energy3000 is also permitted provided that there is a legal obligation to do so. This applies, for example, to surrender obligations in connection with the prevention, investigation, detection or prosecution of criminal data or the execution of sentences, including the protection and prevention of threats to public safety.

8.4 Energy3000 is exceptionally entitled to pass personal data on to an online payment system, to a transport company/shipping company commissioned by us for the delivery of the goods as well as to our tax advisor to fulfill our tax obligations. However, this only applies to the extent that the data is necessary for the proper execution of the payment transaction and for the fulfillment of the contract. In the case of a contract, all data from the contractual relationship is stored, in any case, until the expiration of the tax retention period (7 years).

9. Transmission to third countries

9.1 Your personal data will not be disclosed to third countries subject to the cases expressly mentioned in these terms.

10. Duration of storage/deletion

10.1 Your data will be deleted or anonymised as soon as your personal data is no longer required for the purposes for which it was collected or used in accordance with these terms. This does not apply to personal data which has to be stored in addition due to valid legal framework or legal regulations.

11.1 You have the right to:

a) information about your personal data that we process, that concerns you.

b) correction of your personal data in case of incorrectness or incompleteness,

c) restriction of your personal data if the relevant conditions are fulfilled, in particular if there is a considerable suspicion of unlawful processing or in case of objection,

e) deletion of your personal data in the event of existence of existing legal grounds,

(f) object to the processing of personal data relating to your particular situation, unless Energy3000 can establish compelling legitimate grounds for processing, and

g) complain to us if you believe that improper processing of your personal data has occurred through us. In addition, you also have the right to make a complaint to our supervisory authority.

The processing of your request or your data takes place without affecting the legality of the processing carried out until we have received your request.
